These Terms and Conditions ("Terms") govern your access to and use of the Cold Bore Connections website, classifieds, business directory, business profiles, memberships, and related services ("Services").
By accessing or using Cold Bore Connections, creating an account, purchasing a membership, or posting a listing, you agree to these Terms. If you do not agree to these Terms, do not use the Services.
1. WHAT COLD BORE CONNECTIONS IS
Cold Bore Connections is an online platform designed to connect members of the hunting, fishing, shooting, and outdoor community through classifieds, an outdoor business directory, business profiles, and related resources.
Cold Bore Connections provides a venue for users and businesses to connect.
Cold Bore Connections is not the buyer, seller, dealer, broker, agent, manufacturer, distributor, shipper, or transferor of items advertised by users.
Unless expressly stated otherwise, Cold Bore Connections does not participate in, process, supervise, or complete transactions between buyers and sellers.
2. ELIGIBILITY
You must be at least 18 years old to create an account, post a classified advertisement, contact a seller through member-only features, or otherwise use transaction-related portions of Cold Bore Connections.
Certain products may be subject to additional federal, state, or local age, residency, licensing, possession, transfer, or other legal requirements.
Each user is responsible for determining whether they are legally permitted to buy, sell, advertise, possess, ship, receive, or transfer an item.
3. COMPLIANCE WITH ALL LAWS
Users are solely responsible for complying with all applicable federal, state, and local laws and regulations.
This includes laws and regulations concerning firearms, ammunition, firearm components, hunting and fishing equipment, wildlife products, knives, archery equipment, and other regulated goods or services.
Cold Bore Connections does not provide legal advice and does not determine whether a particular transaction is legal for a particular buyer or seller.
4. FIREARMS AND REGULATED ITEMS
Cold Bore Connections is a classified advertising and connection platform that provides a venue for buyers and sellers to connect. Cold Bore Connections is not a party to transactions between users.
Cold Bore Connections does not sell, purchase, possess, ship, receive, deliver, or transfer firearms advertised through user classifieds.
Cold Bore Connections is not a federally licensed firearms dealer ("FFL") and does not act as an FFL, firearm dealer, transfer agent, broker, or intermediary in transactions between users.
Buyers and sellers are solely responsible for determining and complying with all applicable federal, state, and local laws governing firearm and other regulated-item transactions, including requirements relating to age, eligibility, background checks, residency, possession, shipping, interstate transactions, and transfer through an FFL when required.
Users may not use Cold Bore Connections to avoid, circumvent, or facilitate the violation of any law or legally required firearm-transfer procedure.
Cold Bore Connections does not determine, verify, represent, or guarantee that any particular firearm, regulated item, buyer, seller, listing, shipment, transfer, or proposed transaction is lawful.
The presence of a listing on Cold Bore Connections does not constitute approval, verification, or confirmation of the legality of the item or proposed transaction.
Each buyer and seller is solely responsible for determining the laws applicable to their transaction before completing it.
5. CLASSIFIED LISTINGS
Users may advertise only items they legally own or are otherwise legally authorized to sell or advertise.
Listings must be truthful and reasonably accurate.
Users may not knowingly misrepresent an item's condition, ownership, price, location, description, photographs, or other material information.
Cold Bore Connections may establish posting limits, categories, listing requirements, and additional classified rules.
Cold Bore Connections reserves the right to reject, remove, edit, restrict, or disable a listing that violates these Terms, platform policies, applicable law, or that Cold Bore Connections reasonably determines is inappropriate for the platform.
6. PROHIBITED USE
Users may not use Cold Bore Connections to:
Advertise, buy, sell, transfer, or solicit illegal goods or services.
Facilitate a transaction prohibited by federal, state, or local law.
Engage in fraud, scams, theft, deception, or financial exploitation.
Intentionally provide materially false information.
Impersonate another person or business.
Misrepresent ownership, licensing, credentials, or authority to sell an item.
Harass, threaten, intimidate, or abuse another user.
Introduce malicious software or interfere with the operation or security of the website.
Scrape, harvest, reproduce, or commercially exploit Cold Bore Connections data without authorization.
Use an individual account primarily for commercial business activity contrary to Cold Bore Connections membership rules.
Use the Services for any unlawful purpose.
Cold Bore Connections may cooperate with lawful requests from law-enforcement agencies and government authorities when required by law.
7. TRANSACTIONS ARE BETWEEN USERS
Any transaction resulting from a classified advertisement is between the buyer and seller.
Unless expressly provided as a separate service, Cold Bore Connections does not:
Collect or hold purchase funds between buyers and sellers.
Provide escrow services.
Inspect merchandise.
Take possession of merchandise.
Arrange firearm transfers.
Determine whether a buyer or seller may legally complete a transaction.
Guarantee the identity of a buyer or seller.
Guarantee the condition, quality, authenticity, safety, legality, or ownership of an advertised item.
Guarantee payment or delivery.
Resolve private disputes between buyers and sellers.
Users are responsible for conducting their own due diligence before completing a transaction.
8. USER SAFETY AND FRAUD
Transactions and communications with people you do not know involve risk.
Cold Bore Connections does not guarantee the identity, honesty, reliability, or legal eligibility of any user.
Users should independently verify information and use appropriate precautions before exchanging money, merchandise, financial information, or other personal information.
Users should report suspected fraud, scams, stolen property, or illegal activity to Cold Bore Connections.
9. BUSINESS DIRECTORY AND BUSINESS PROFILES
Cold Bore Connections provides a directory intended to help users locate and connect with outdoor-related businesses.
Businesses are responsible for the accuracy of information they submit, including contact information, services, products, hours, locations, licenses, and other business information.
Unless expressly stated otherwise, inclusion of a business in the Cold Bore Connections directory does not constitute a guarantee, certification, warranty, or endorsement of that business or its products or services.
Users are responsible for conducting their own evaluation of a business before entering into a transaction.
10. MEMBERSHIPS AND FEES
Certain Cold Bore Connections features require a paid membership, business membership, advertising fee, or other payment.
Membership prices, benefits, posting limits, and other applicable terms will be disclosed at the time of purchase.
Cold Bore Connections may change membership pricing or features from time to time. Changes will not alter the price of an already-paid membership period unless expressly agreed to by the member.
11. AUTOMATIC RENEWAL
Unless otherwise stated at the time of purchase, annual paid memberships automatically renew at the end of each membership term using the payment method on file.
Cold Bore Connections will provide reasonable advance notice of an upcoming automatic renewal. The notice will identify the upcoming renewal and, where required or appropriate, the amount that will be charged.
Members may cancel automatic renewal before the applicable renewal date to prevent the next membership charge.
Cancellation stops future renewals but does not terminate the member's access for the remainder of an already-paid membership period.
If Cold Bore Connections materially changes the renewal price, members will be notified before the new price is charged.
Automatic-renewal terms will also be disclosed during the membership purchase process as required by applicable law.
12. CANCELLATIONS AND REFUNDS
Members may cancel future automatic renewal at any time before the applicable renewal date.
Unless otherwise stated at the time of purchase or required by applicable law, membership fees are non-refundable once the applicable paid membership period has begun.
Cancellation does not result in a prorated refund for the unused portion of an existing membership term unless required by law.
13. BUSINESS AND COMMERCIAL ACCOUNTS
Individual memberships are intended for personal, non-commercial use.
Businesses, dealers, retailers, outfitters, guides, service providers, manufacturers, and other commercial operations may be required to maintain an appropriate Cold Bore Connections business membership.
Cold Bore Connections reserves the right to restrict or reclassify an account that is being used primarily for commercial purposes under an individual membership.
14. EXCLUSIVE BUSINESS ARRANGEMENTS
Certain business programs, sponsorships, category partnerships, or exclusive arrangements may be governed by additional written terms.
Where separate written terms exist, those terms control with respect to that particular business relationship if they conflict with these general Terms.
Any applicable renewal, cancellation, exclusivity, territory, category, or notice requirements for such arrangements will be stated in the applicable agreement.
15. ACCOUNT RESPONSIBILITY
Users are responsible for maintaining the confidentiality of their account credentials and for activity conducted through their accounts.
Users must provide reasonably accurate information when creating and maintaining an account.
Unauthorized account access should be reported to Cold Bore Connections promptly.
16. MODERATION AND ACCOUNT ENFORCEMENT
Cold Bore Connections reserves the right to moderate the platform and enforce these Terms.
Cold Bore Connections may remove content or listings, restrict features, suspend accounts, terminate accounts, or deny access when it reasonably believes a user has violated these Terms, applicable platform policies, applicable law, or the rights or safety of others.
Cold Bore Connections is not obligated to publish or continue displaying any particular listing, advertisement, business profile, or other user content.
17. USER CONTENT
Users retain ownership of photographs, descriptions, logos, and other original content they submit.
By submitting content to Cold Bore Connections, users grant Cold Bore Connections a non-exclusive, worldwide, royalty-free license to host, reproduce, display, format, distribute, and otherwise use that content as reasonably necessary to operate, market, and improve Cold Bore Connections.
Users represent that they own or otherwise have the legal right to submit the content they provide.
18. INTELLECTUAL PROPERTY
The Cold Bore Connections name, logos, branding, website design, original text, graphics, software, and other proprietary materials are owned by or licensed to Cold Bore Connections.
They may not be copied, reproduced, distributed, modified, or commercially exploited without authorization except as permitted by applicable law.
19. THIRD-PARTY SERVICES
Cold Bore Connections may provide links or access to third-party websites, payment processors, businesses, maps, or other services.
Cold Bore Connections does not control and is not responsible for third-party websites, services, content, security, products, policies, or business practices.
Third-party services may be governed by their own terms and privacy policies.
20. DISCLAIMER OF WARRANTIES
To the fullest extent permitted by law, Cold Bore Connections and its Services are provided on an "as is" and "as available" basis.
Cold Bore Connections does not guarantee uninterrupted or error-free operation, successful transactions, the accuracy of every listing, the availability of any particular item or business, or any particular result from use of the Services.
21. ASSUMPTION OF RISK
Users understand that online communications and transactions involving strangers, used merchandise, outdoor equipment, firearms, and regulated products may involve risks.
Users voluntarily assume the risks associated with communications, meetings, purchases, sales, transfers, shipping arrangements, and other transactions resulting from use of Cold Bore Connections.
22. LIMITATION OF LIABILITY
To the fullest extent permitted by law, Cold Bore Connections and its owners, officers, employees, contractors, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to use of the Services or transactions between users.
This includes, without limitation, losses arising from fraud, scams, stolen property, defective products, inaccurate listings, failed payments, failed delivery, shipping problems, personal meetings, unlawful transactions, personal injury, property damage, or disputes between users or businesses.
Nothing in these Terms limits liability that cannot legally be excluded or limited.
23. INDEMNIFICATION
To the fullest extent permitted by law, users agree to defend, indemnify, and hold harmless Cold Bore Connections and its owners, officers, employees, contractors, and affiliates from claims, liabilities, damages, losses, and reasonable costs arising from the user's listings, transactions, unlawful conduct, violation of these Terms, or infringement of another person's rights.
24. PRIVACY
Use of Cold Bore Connections is also subject to the Cold Bore Connections Privacy Policy.
The Privacy Policy explains how Cold Bore Connections collects, uses, stores, and discloses personal information.
25. CHANGES TO THESE TERMS
Cold Bore Connections may update these Terms from time to time.
Material changes may be communicated through the website, email, account notification, or another reasonable method.
Continued use of the Services after revised Terms become effective constitutes acceptance of the revised Terms to the extent permitted by applicable law.
26. GOVERNING LAW
These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-law principles, except where applicable federal law or another jurisdiction's non-waivable law controls.
27. SEVERABILITY
If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law.
28. ENTIRE AGREEMENT
These Terms, the Cold Bore Connections Privacy Policy, applicable classified rules, and any other policies expressly incorporated into these Terms constitute the agreement governing use of Cold Bore Connections.
Separate written business or partnership agreements may contain additional terms applicable to those relationships.
I understand and agree that Cold Bore Connections is a classified advertising platform and is not involved in transactions between users. I am solely responsible for knowing and complying with all applicable federal, state, and local laws relating to my listings and transactions, and I accept responsibility for my use of Cold Bore Connections.
